The Applicant accepts and agrees to the Standard Form of Agreement and EFM Broadband Service Description.
The Applicant also agrees to the product specific details and pricing included in this application. The Applicant also confirms that he/she is 18 years of age or older. If the Applicant is a company then the person signing this form warrants that he/she is authorised to execute this Agreement on behalf of the company.
You accept all responsibility for arranging, paying for and maintaining all cable required from the network boundary point, to the point where you
wish to use the service. Billing of the service will commence within seven days of it being installed to the network boundary point, regardless of
whether you have arranged any required additional cabling or not.
■ You will be required to provide technicians with access to your premises, for the purposes of installing the EFM Broadband service. You agree that the type and location of the telephone point is at the installation technician’s discretion.
■ In any location with a Main Distribution Frame, you may need to arrange additional inbuilding
cabling (at your expense) to bring the service from the Main Distribution Frame to your required location.
Customer agrees that an early termination fee is payable if the service is canceled during the initial Contract term. The early termination fee is calculated by the monthly fee multiplied by the remaining pro-rated initial Contract term. Speed downgrades are not permitted. Relocations during the initial Contract term may attract an early termination fee. Costs for relocation are priced upon application.
- Customer agrees that Supplier may modify the EFM Service and the EFM Service Levels from time to time.
- Customer acknowledges that the EFM Service may rely upon the operation of third party networks operated by third party carriers and third party services provided by other Carriage Service Providers.
- Customer acknowledges that the EFM Service may be switched from one third party network to another at any time which may result in a loss of service wholly or in part and may result in a new IP address allocation to the service.
- Customer further acknowledges that Supplier is unable to guarantee the operation of or the use of the EFM Service through third party supplier networks or other third party carriers and Carriage Service Providers. Any failure of the EFM Service caused by a third party network or third party service is beyond the control of Supplier, and Supplier will not be responsible to, or liable to Customer, for any such failures.
- Customer acknowledges and agrees that Supplier does not warrant, and has not represented, that the EFM Service is or will be free of errors, defects or interruptions, or that it will be available at all times.
- Customer acknowledges that Supplier is required to supply certain Customer information to regulators for their purposes including but not limited any public number allocated, Customer's name and address, location of the EFM Service being provided and the purpose of use.
- Without limiting Suppliers Service Level obligations to Customer, Customer agrees that Supplier may from time to time, conduct maintenance on and of the network and infrastructure through which the EFM Service is provided. Supplier will try to conduct such maintenance outside Suppliers usual business hours, but Customer acknowledges that it may not always be possible for Supplier to do so and Supplier shall not be liable for any interruptions in the EFM Service Level during such maintenance operations.
- Customer agrees that Supplier will not be responsible for rectifying any fault in the EFM Service if that fault arises in or is caused by a network or infrastructure of another supplier of telecommunications services, Customers own equipment or any other infrastructure, equipment or facilities that are outside Supplier’s reasonable control or responsibility.
